What a summary judgment application is
Summary judgment allows the court to decide a claim or defence without a trial where:
a party has no real prospect of succeeding or defending, and
there is no compelling reason for the case to proceed to trial.
These applications are governed by CPR 24, and the court expects a clear legal and evidential basis for the application or the response. A successful application requires a detailed statement of facts, properly drafted legal submissions and evidence supporting the points relied upon.
If you are responding to a summary judgment application, the court will expect you to show that your case has a real prospect of success or that the case should proceed to trial.
