What an MPS application is
A Maintenance Pending Suit (MPS) application asks the court to order temporary financial support while financial remedy proceedings are ongoing. It may be appropriate where:
one party has significantly greater resources,
the applicant cannot meet essential needs,
there is financial control or obstruction, or
interim support is required pending a final order.
The court will consider the standard of living during the marriage, the needs and resources of each party, and whether the application is reasonable and proportionate.
An effective MPS application requires a concise explanation of income, expenditure, financial needs and available resources, supported by a clear witness statement and appropriate disclosure.
