What a freezing injunction is
A civil freezing injunction (formerly a Mareva injunction) is an urgent court order preventing a person from dealing with or disposing of assets before a claim is resolved. It is typically sought where:
there is a good arguable case,
there is a real risk of dissipation, and
the injunction is just and convenient.
Freezing injunctions may apply to:
bank accounts,
shares and investments,
property and land,
business assets, or
assets held through third parties.
The application must be supported by a detailed witness statement and a confidential schedule of assets. The applicant has a strict duty of full and frank disclosure, and the court may require a cross-undertaking in damages.
If you have been served with a freezing injunction, you may need to respond urgently with evidence, legal submissions and a variation/discharge application.
I prepare the application or response, draft the evidence, advise on the risks and requirements, and guide you through the urgent hearing process.
