What a freezing injunction is

A civil freezing injunction (formerly a Mareva injunction) is an urgent court order preventing a person from dealing with or disposing of assets before a claim is resolved. It is typically sought where:

  • there is a good arguable case,

  • there is a real risk of dissipation, and

  • the injunction is just and convenient.

Freezing injunctions may apply to:

  • bank accounts,

  • shares and investments,

  • property and land,

  • business assets, or

  • assets held through third parties.

The application must be supported by a detailed witness statement and a confidential schedule of assets. The applicant has a strict duty of full and frank disclosure, and the court may require a cross-undertaking in damages.
