Appealing a fast track decision

Fast track appeals must be filed within 21 days of the decision.
If the deadline is missed, you must seek permission to appeal out of time and explain the delay, which reduces the prospects of success.

Fast track appeals are not re-hearings. The appeal court considers whether the judge:

  • made an error of law,

  • misapplied legal principles,

  • made findings that were not open on the evidence, or

  • acted unfairly or procedurally incorrectly.

An effective appeal requires:

  • a clearly drafted appellant’s notice,

  • concise and structured grounds of appeal, and

  • focused written submissions.

The fee may vary depending on the length of the judgment, complexity and urgency.
Representation at permission and appeal hearings can be added as a further fixed fee.
